J: Exactly. The arbitration c l a use is important for both of us. When we can't reach an agreement in case of the dispute, It helps us to get fair and reasonable solution.

J: Isn't there a phrase in China which says “We are afraid of 10,000 but one risk”? I think It is quite right. Writing this in the contract is not harmful to any party.

W: Well, we will do just as you said. Where shall we locate the arbitration institution, in our country or your country?
那好吧。就聽(tīng)你的。仲裁機(jī)構(gòu)我們應(yīng)該設(shè)在哪里，我們國(guó)家還是你們國(guó)家呢?
J: Neither is good.In order to make the arbitration results fair, unbiased and impartiality, I consider it is the best to set it in the third country.
這樣都是不好的。為了仲裁結(jié)果的公平、無(wú)偏見(jiàn)和偏袒，我認(rèn)為設(shè)在第三國(guó)是最好的。
W: Good. We will set it in South Korea, which is not far from any of our country.
好的。我們就把他設(shè)在韓國(guó)吧，這離我們都不是很遠(yuǎn)。
J: That is a good idea. The referee's award on the dispute is final and binding on the both sides. Another thing to be mentioned is that the losing party shall bear all the arbitration fee.
好主意。仲裁人對(duì)爭(zhēng)執(zhí)的裁決是終局性的， 對(duì)雙萬(wàn)均具有約束性。另外還要說(shuō)明一點(diǎn)，失敗的一方要承受仲裁費(fèi)用。
